The following are the terms and conditions for use of Syllogistics' services. Please read them carefully. Our Service is offered to you with the condition you accept without modification the terms and conditions contained herein. Syllogistics may change the Terms of Service at any time. You understand that by using the Service after a change becomes effective, you have agreed to it. By purchasing Service from Syllogistics, you are indicating your agreement to be bound by all of the terms and conditions set forth in this document. Guarantee of services Syllogistics does not guarantee that it will be able to resolve every issue. Any services provided shall be in accordance with the limited warranty stated below. Our philosophy is to provide the highest quality service with 100% customer satisfaction. In almost every instance our customers' computer problems are resolved once service is complete. On the rare occasion where a customer's problem is not completely resolved, the customer may contact us within 5 days from the date of service. At that time we will attempt to resolve the issue to the satisfaction of the customer or issue a refund. Syllogistics has sole discretion in determining if a refund will be issued, and if it will be a full or partial refund. Right of refusal Syllogistics has the right to refuse service to any customer in its sole discretion without notice. Delay of services In the event Syllogistics delivery of services is delayed, prevented or made impracticable by catastrophic events such as fire, flood, earthquake, or other catastrophes, power outages, internet service outages, equipment failure, or any other issues that are beyond Syllogistics' reasonable control, Syllogistics shall not be held responsible for the delays by such cause. Lost or altered computer files Customer is responsible for backing up all files and proprietary and confidential information on the computer and for maintaining a procedure external to the hardware products for the reconstruction of lost or altered files, data or programs. Syllogistics shall not be liable for lost or altered files, data or programs, even if caused by the negligence of Syllogistics or it's agents or employees. Diagnostic and repair services are provided without any obligation of confidentiality or nondisclosure on the part of Syllogistics, it's employees or agents. Customer shall delete from the computer any file or data considered to be private, confidential or proprietary. Limitation of liability Except where such exclusion is contrary to public policy, in no event shall Syllogistics, its employees, agents or contractors, be liable under this agreement for any agreement for any indirect, special, exemplary, consequential, or incidental damages, including, but not limited to, loss of anticipated profits or revenue, economic loss, loss of data, loss of use of the product or any associated equipment, cost of capital, cost of substitute or replacement equipment, facilities or services, down time, customer time, the claims of third parties, and injury to property, regardless of the nature of the claim, including but not limited to, breach of warranty, breach of contract, tort (including negligence) or strict liability, and even if Syllogistics has been advised of the possibility of such loss or damage. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply. If any portion of this section is held invalid or unenforceable, any liability of Syllogistics and its suppliers and service providers under this agreement is expressly limited to the fees the customer has paid for the service giving rise to the claim. The customer's sole remedy against Syllogistics and its suppliers and service providers in any dispute under this agreement shall be to seek recovery of the amounts the customer has paid, upon the payment of which Syllogistics and its suppliers and service providers shall be released from and discharged of all further obligations and liability to the customer. Website use While Syllogistics uses reasonable efforts to include accurate and up-to-date information on the Site, Syllogistics makes no warranties or representations as to its accuracy. Syllogistics assumes no liability or responsibility for any errors or omissions in the content on the Site. Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by Syllogistics or its affiliates for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting.
